  1. Purpose of disclosure.

This web page describes – in fulfillment of legal obligations and in the interest of users consulting EvoTech’s website – how the website is managed with regard to the use of cookies, their function and changing their settings.

    • “third-party” cookies, are the cookies sent, placed and stored in the user’s terminal device by parties other than EvoTech, this situation occurs in particular when there are elements (images, maps, sounds, specific links to web pages of other domains, etc.) on the site the user is visiting that are placed on servers other than that of the visited site.

However, the most relevant distinction concerns the function performed by the cookie. In fact, the legal regime and rules applicable to cookies, their management, the consent to be given in connection with their placement in the user’s terminal device as well as the manner in which the aforementioned consent must be given, ultimately depend on their qualification as:

  • “Technical” cookies, are cookies that, according to art. 122, co. 1, of Legislative Decree 30.06.2003 no. 196 (so-called Privacy Code), are used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or to extent the strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide such service.” In other words, these are cookies that are indispensable or otherwise functional for the proper and efficient functioning of the website from which they are placed and installed. This type of cookie allows, for example, to simplify the connection and data transmissions between the user and the site, allows to store information on specific configurations concerning users accessing the server, etc.. In relation to the installation of this category of cookies, it is not necessary for the owner of the website (so-called Publisher, or “first party”) to acquire the user’s consent, but the cookies used must nevertheless be indicated in the information (on this point, see below);
  •  “analytics” cookies, are both “first” and “third-party” cookies, which are used to assess the effectiveness of an information society service provided by a Publisher, design websites or help measure the number of visitors, including possibly broken down by geographic area, time slot or other. This type of cookie is comparable to “technical” cookies in terms of the legal treatment related to the acquisition of user consent provided that:
    • they are only used to produce aggregate statistics and in relation to a single site or mobile application;
    • at least the fourth component of the IP address is masked for those of “third parties”;
    • the “third parties” refrain from combining analytics cookies, thus minimized, with other processing or passing them on to further third parties;
  • “non-technical” cookies, are cookies used to trace back to specific, identified or identifiable subjects specific actions or recurring behavioral patterns in the use of the offered functionalities (pattern) in order to group the different profiles within homogeneous clusters of different width, so that it is also possible to modulate the provision of the service in an increasingly personalized way, as well as to send targeted advertising messages, i.e. in line with the preferences expressed by the user in the context of surfing the web. In connection with the installation and use of this type of cookie by the website owner (so-called Publisher, or “first party”), the user’s consent is always required.

2.3 Also subject to classification according to the criteria explained above, and consequently to the legal regime that follows from the aforementioned classification, are other tracking tools other than cookies called “passive tracking tools.”

The aforementioned tools may pursue the same purposes and functions as cookies and, therefore, may also be used for profiling purposes.

Users are informed that EvoTech does not use “passive tracking tools.”

The user has the right to grant, revoke or modify at any time his/her consent to the installation and use of “non-technical” cookies. Consent can also be given or revoked in relation to each individual cookie.

EvoTech uses “third-party” cookies. This section contains updated links to the privacy policy and consent forms of the “third parties” that install cookies on the user’s terminal device through the www.evotech.it website  and therefore use information relating to the users of the aforementioned site.

The user is informed that some “third-party” systems that use cookies provide tools for users to block the installation of their own cookies (so-called right to object).
