However, the above information does not concern other sites, pages or online services that can be reached through hypertext links that may be published on the aforementioned site but which refer to resources outside the domain of EvoTech S.r.l..

Data controller

Following consultation of the www.evotech.it website, personal data relating to identified or identifiable natural persons may be processed.

“Processing” means any operation mentioned in Article 4 n.2 of the GDPR.

Modalities and duration of treatment

Personal data supplied to or acquired by EvoTech S.r.l. are processed in accordance with the principles of correctness, lawfulness, transparency and protection of confidentiality pursuant to current legislation.

Processing is carried out with paper and magnetic support, manually or by electronic instruments or automated systems. Personal Data are retained for a period not exceeding the period necessary to achieve the purposes for which they are acquired or processed, or in accordance with the terms of document retention obligations (e.g. tax or administrative) or with the deadlines laid down by legal regulations (e.g. regulations on the limitation of rights).

Purpose and legal basis of processing

Browsing data

The computer systems and software procedures used to operate this site acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.

This category of data includes the IP addresses or domain names of the computers and terminals used by users, the URI/URL addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment.

These data, necessary for the function of the web services, are processed for the purpose of:

• obtain statistical information on the use of the services (most visited pages, number of visitors per daily time slot, geographical areas of origin, etc.)
• check the proper functioning of the services offered.

This type of data is mostly acquired through the Holder’s use of Cookies and other tracking tools.

In particular, the legal basis of the Processing of Personal Data collected through ‘technical’ cookies is art. 122 D. Lgs. 196/2003, while the legal basis for the acquisition of Data by means of ‘non-technical’ cookies is, pursuant to the same art. 122, the consent of the person concerned.

Data provided by the user

• On the EvoTech S.r.l. website there is a ‘Contact Us’ section, which can be activated by means of a form or by sending an e-mail to info@evotech.it. The personal data processed in the context of this function (first name, surname, e-mail address of the applicant, content of the message sent) are used exclusively to respond to the request and are kept for a period not exceeding that necessary to manage and process the transaction. In any case, any data no longer required for other purposes (which will then be declared to the person concerned: e.g. to initiate and maintain a professional or business relationship) will be deleted from the Data Controller’s archives.
  • The pages and the consultation or interlocution parts reserved for registered users are associated with the registration which allows the user to consciously and voluntarily take advantage of the services and functions proposed and described from case to case: the data provided and the data that in time EvoTech S.r.l. may acquire in the above manner, will be processed either on the basis of consent given explicitly by the data subject on a case by case basis (e.g. by subscribing to advertising or marketing mailing lists), or even without the prior consent of the data subject, insofar as they are linked to information or updating services (e.g. informative newsletters), or to the purchase of products and services through the EvoTech S.r.l. website.

The purposes of the processing, in the different aforementioned cases, are: (a) related to the user’s consent, which is free, conscious, specific and informed, and always revocable (Legal Basis); (b) that of following up on the relational, pre-contractual and contractual needs arising from the user’s request.

Only in the case of further and specific consent of the user concerned (Legal Basis), Personal Data may be processed in the context of the following activities carried out by means of paper mail, landline or mobile telephone, automated calling systems or other remote communication systems (social instant messaging, sms, mms, e-mail) in relation to which the user has the right to manifest or not his consent as well as to revoke it at any time through the modalities of case by case highlighted.

In connection with the above, EvoTech S.r.l. may develop:

• activities of sending its own informative or promotional newsletters;
• marketing activities regarding its own products or services.

Any interested user may at any time object to the use of one, more or all of the means of communication used for the above-mentioned activities by sending appropriate notice to the Owner at the e-mail address: info@evotech.it.

Please note that the provision of Data marked with an asterisk (*) is mandatory for the pursuit of the contractual and pre-contractual purposes described above. On the other hand, the provision of further Data is optional.

Failure to provide the processing of all Data marked with an asterisk (*) will result in the inability to register and/or make purchases of services or products offered on the site. On the other hand, failure to provide further Data will have no consequences.

Recipients of the Data

In addition to the Data Controller, in some cases, the Data may be accessed by:

• external parties (such as intellectual professionals appointed by EvoTech S.r.l.; providers of technical, multimedia, marketing and/or IT services);
• public or private parties who may access the Data in compliance with legal obligations.

The aforementioned individuals are defined, in accordance with Article 28 GDPR, as Data Processors and are bound to the Data Controller by a contractual relationship. The Data Processors act in compliance with current regulations and are subject to the instructions given by the Data Controller.

Personal Data are not transferred outside the European Union.

In any case, Personal Data will not be disseminated.

Rights of affected users

The interested parties have the right to obtain from EvoTech S.r.l., in the cases provided for, access to their personal data and the rectification or cancellation thereof or the restriction of the processing concerning them or to object to the processing thereof (art. 15 et seq. of the Regulation).

It should be noted that the consent given by the user may be revoked at any time without, however, affecting the lawfulness of the processing based on the consent given before revocation.

Right of complaint

Data subjects who believe that the processing of Personal Data relating to them carried out through this site is in violation of the provisions of the GDPR have the right to lodge a complaint with the Personal Data Protection Authority, as provided for in Article 77 of the GDPR, or to take appropriate legal action (see Article 79 of the GDPR).
